Federal Court Orders Freedom of Abrego Garcia from Immigration Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case stems from a mistaken removal to El Salvador in March, which US authorities later admitted was an mistake. After his return to the United States to answer alien smuggling charges, he was detained in federal detention.
In her order, the judge noted that the government does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Background of the Case
The court challenge involve conflicting assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this claim.
He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing trial in the state of Tennessee.
Conditions of Release
The judge, who was hearing his petition to deportation in a federal court, determined that he must now adhere to the terms of his release from custody in Tennessee. This order shifts his monitoring to the Tennessee court.
This ruling represents a significant development in a complex immigration case involving allegations of mistaken imprisonment and contested criminal affiliations.
